The draft revision of the Patent Law is seeking public opinion

On 1st April 2015, the state Intellectual Property Office announced the “People’s Republic of China Patent Law Amendment Bill (draft) to solicit public comment. Thereafter, continuing promoting the discussion and modification on the patent law, the SIPO submitted the amendment to the Legislative Affairs Office of the State Council for consideration.
On December 2nd 2015, the draft revision of the Patent Law was published by the Legislative Affairs Office of the State Council to seek public opinion.
The draft revision involved a total of 33 substantive changes, among which, the modification of existing provisions are 18 articles, 14 articles were newly added and 1 article got deleted. Besides, 4 provisions got text modification or adjusted.
Aiming at the striking problems in the implementation of patent, corresponding measures were proposed, such as adding protection for portion appearance design, optimizing the procedures for patent applications, examination, review and invalidation, defining the principles of ex officio review in patent examination and invalidation procedures.
